15. In the whole I entertained few doubts as to the convictions & sentences in this case, that I declined to mitigate the severity of the various imprisonments & floggings, which the former had fully undergone, further punishment of deportation.
16. Having already reported on the enclosed papers and explained the course I felt compelled to take, I venture to solicit your Lordships' particular attention to two points of some importance. The first is the interpretation I have ventured to put on Ordinance 2° of 1855, Section 4. The Attorney General in his later opinion seems to take the same view; the adjudication of fine or penalty within twelve months should in each case be reported forthwith. The Governor could have no legal prospective effect in contemplation of imprisonment. If I am right, there have been hundreds of cases of this kind improperly dealt with by the Magistrates; for the second sentence I have quoted in a preceding paragraph (13) is the form of sentence pronounced week after week by F.W. Russell when they desire...
